Newly released files from the US Department of Justice reveal that early draft statements by New York prosecutors regarding the Jeffrey Epstein death were dated a day earlier than the official announcement and made no mention of suicide as the cause.

DOJ files reveal timeline inconsistencies in Epstein death statement

The documents, published as part of an ongoing release of materials related to the Epstein case files, include over 20 versions of a draft statement prepared by then-US Attorney Geoffrey Berman for the Southern District of New York.

Two of these drafts, unlike the rest, were dated August 9, 2019, a day before the Bureau of Prisons officially confirmed Epstein’s death. In one version, Berman wrote:

"Earlier this morning, the Manhattan Correctional Center confirmed that Jeffrey Epstein, who faced charges brought by this Office of engaging in the sex trafficking of minors, had been found unresponsive in his cell and pronounced dead shortly thereafter," former US Attorney Geoffrey Berman for the Southern District of New York said in a draft statement dated August 9, 2019. 

Early drafts lacked reference to suicide

Among the documents released by the US Department of Justice, two draft press statements dated August 9, 2019, stood out for their omission of any reference to suicide as the cause of Jeffrey Epstein's death. These drafts were prepared before the Bureau of Prisons officially confirmed the incident on August 10.

In the early versions, Epstein was described as having been found “unresponsive” in his cell and later pronounced dead, but the statements did not identify the nature or suspected cause of his death. This omission contrasts with later official narratives, which stated that Epstein died by suicide.

The absence of suicide references in the initial drafts has drawn attention due to the high-profile nature of the case and the public scrutiny surrounding the circumstances of his death.

Over 20 versions of prosecutor statement released

The recently disclosed Epstein prison documents reveal that the US Department of Justice released more than 20 versions of the draft statement prepared by former US Attorney Geoffrey Berman. These drafts were created following Epstein’s death while in custody at the Manhattan Correctional Center.

While the majority of the drafts were dated August 10, 2019, which aligns with the official date of Epstein’s death, at least two versions carried the earlier date of August 9.

The existence of these earlier drafts suggests that officials may have been preparing public messaging before the official confirmation or announcement was made.

The content across these versions varied slightly, with most referring to Epstein being found unresponsive in his cell, but not all including details about the cause of death. 

Epstein faced charges of sex trafficking minors

At the time of his death, Jeffrey Epstein was facing federal charges in the US related to the sex trafficking of minors, with prosecutors accusing him of operating a wide-ranging criminal scheme between 2002 and 2005.

He was alleged to have abused dozens of underage girls, some as young as 14 years old, often paying them in cash and using some victims to recruit others.

Epstein was arrested in July 2019 and denied bail by a Manhattan court. The charges carried a potential sentence of up to 40 years in prison.

Prosecutors also charged him with conspiracy to commit sex trafficking, indicating that others may have been involved in facilitating the abuse.

The case reignited scrutiny over Epstein’s prior legal history and the controversial 2008 plea deal in Florida, under which he avoided federal prosecution. His 2019 arrest brought renewed attention to powerful figures within his network, increasing public interest and media coverage surrounding the case.

On August 10, 2019, Epstein was found in his jail cell in a reportedly semi-conscious state and was later pronounced dead. The official cause of death was ruled as suicide, though questions and speculation have persisted.

Latest release mentions prominent figures in case files

As part of the final data release related to the Jeffrey Epstein case files, the US Department of Justice has made public over 3.5 million documents, some of which reference prominent global figures. These include billionaire entrepreneur Elon Musk, Microsoft co-founder Bill Gates, and former US President Bill Clinton.

On January 30, 2026, US Deputy Attorney General Todd Blanche announced the completion of the Epstein document release, marking the end of a multi-year process to declassify and disclose all relevant files. The newly published material is expected to undergo further scrutiny by journalists, legal analysts, and the public in the weeks ahead.
